These Terms of Service (“Terms”) govern your access to and use of the Nitolio mobile application and related services (the “Service”), operated by Martin Zivkovic, Serbia (“Developer”, “we”, “us”, or “our”).
By using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service
Nitolio is a weight tracking and progress insight application designed to help users monitor their weight, set goals, and track related data such as calorie intake, protein intake, and workout intensity.
The Service provides tools and insights to support users in reaching their personal fitness or weight goals.
The Service may evolve over time. We may add, modify, or remove features to improve functionality or comply with legal or platform requirements.
2. Eligibility
You must be at least 13 years old to use the Service.
By using the Service, you represent that you meet this requirement and are legally able to enter into these Terms.
3. Data & Device Usage
Nitolio does not require account creation.
Your data (such as weight logs, goals, and preferences) may be stored:
Locally on your device, and/or
In your personal iCloud account using Apple CloudKit
You are responsible for:
Maintaining access to your device and iCloud account
Managing your own data
Deleting the app or disabling iCloud may result in loss of your data.
4. Subscriptions & Payments
Nitolio offers optional auto-renewable subscriptions that provide access to premium features.
Key points:
Payments are processed by Apple through your Apple ID
Subscription prices and durations are displayed in the App Store
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period
You can manage or cancel subscriptions in your Apple ID account settings
The Developer:
Does not process payments directly
Does not store your payment information
Refunds are handled according to Apple’s refund policies.
5. Acceptable Use
You agree not to:
Use the Service for unlawful purposes
Attempt to interfere with or disrupt the Service
Abuse, exploit, or misuse the Service
Attempt to gain unauthorized access to systems or data
We may suspend or restrict access to the Service if these Terms are violated.
6. Health Disclaimer
Nitolio is intended for informational and educational purposes only.
It does not provide medical advice, diagnosis, or treatment.
You should consult a qualified healthcare professional before making decisions related to your health, diet, or exercise.
Use of the Service is at your own risk.
7. Availability & Changes
The Service is provided on an “as available” basis.
We do not guarantee:
uninterrupted availability
error-free operation
We may temporarily suspend or modify the Service at any time for maintenance, updates, or technical reasons.
8. Termination
You may stop using the Service at any time.
We may suspend or terminate access to the Service if:
these Terms are violated
required by law or platform policies
the Service is discontinued
Termination does not automatically cancel active subscriptions.
9. Disclaimer of Warranties
The Service is provided without warranties of any kind.
We do not guarantee:
specific results (such as weight loss or fitness improvements)
accuracy of insights or recommendations
Use of the Service is at your own discretion.
10. Limitation of Liability
To the maximum extent permitted by law, the Developer shall not be liable for indirect, incidental, special, or consequential damages arising from your use of the Service.
Nothing in these Terms limits liability where such limitation is prohibited by law.

12. Changes to These Terms
We may update these Terms from time to time.
Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
